1. Definitions
"Service" refers to the residential programs, social clubs, and community living arrangements offered by Sala Drift. "User" or "You" refers to any individual who accesses our website, submits an enquiry, or participates in any Sala Drift program. "We", "Us", or "Our" refers to Sala Drift, located at 67 Moo 2, Hua Hin Soi 102, Hua Hin, Prachuap Khiri Khan 77110, Thailand. "Agreement" refers to these Terms & Conditions together with any program-specific terms communicated at the time of enrolment.
2. Acceptance of Terms
By accessing our website, submitting a contact form, enrolling in a program, or otherwise engaging with Sala Drift, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of our website and services. You must be at least 18 years of age or acting on behalf of someone who is, with proper authorisation, to use our services.
3. Description of Services
Sala Drift provides non-medical senior residential community programs in Hua Hin, Thailand. Our offerings include the Afternoon Social Club, the Respite Stay Program, and the Coastal Living Annual Membership. These services include social activities, meals, coordination support, and access to community amenities as described in program materials. We do not provide medical, nursing, or healthcare services of any kind.
4. User Responsibilities
When using our website or services, you agree to: provide accurate and truthful information in all forms and communications, treat staff and fellow residents with respect, follow community guidelines provided at enrolment, inform us of any relevant health conditions or requirements that may affect your participation, refrain from engaging in disruptive or harmful behaviour on our premises, and comply with all applicable Thai laws.
5. Intellectual Property
All content on this website — including text, images, logos, layout, and design — is the property of Sala Drift and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive licence to view this content for personal, non-commercial purposes. You may not reproduce, distribute, or modify any part of this website without our prior written consent.
6. Payment Terms
Program fees are listed in Thai Baht (THB) and are payable as follows: the Afternoon Social Club is billed monthly, the Respite Stay Program is billed weekly, and the Coastal Living Annual Membership is billed monthly. Payment is due at the start of each billing period. Accepted payment methods include bank transfer and credit card. All fees are inclusive of meals, activities, and amenities as described in program details. We reserve the right to adjust pricing with thirty days' written notice.
7. Cancellation and Refund Policy
For the Afternoon Social Club, monthly subscriptions may be cancelled with fourteen days' notice before the next billing period. For the Respite Stay Program, cancellations made at least seven days before the arrival date are eligible for a full refund. Cancellations within seven days of arrival may be subject to a one-week non-refundable fee. For the Coastal Living Annual Membership, cancellation terms are outlined in the individual membership agreement signed at enrolment.
8. Disclaimers
Sala Drift is a non-medical residential community. Our services are provided on an "as is" basis. We do not make any representations or warranties regarding specific health outcomes, medical improvements, or physical recovery. We strongly recommend that residents maintain relationships with their own healthcare providers for any medical needs. Information on our website is for general purposes and should not be taken as professional medical or legal advice.
9. Limitation of Liability
To the fullest extent permitted by Thai law, Sala Drift shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of our services or website. Our total liability for any claim shall not exceed the total fees paid by you for the program in which the claim arose. This limitation applies regardless of the legal theory under which such liability is asserted.
10. Indemnification
You agree to indemnify and hold harmless Sala Drift, its owners, staff, and affiliates from any claims, losses, liabilities, or expenses arising from your use of our services, your breach of these terms, or your conduct on our premises.
11. Termination
Either party may terminate participation in a program in accordance with the cancellation terms outlined above. Sala Drift reserves the right to terminate a resident's participation immediately in cases of serious misconduct, behaviour that endangers others, or material breach of these terms. In such cases, we will provide a written explanation and arrange a safe transition.
12. Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these terms or our services shall first be addressed through informal discussion between the parties. If a resolution cannot be reached informally within thirty days, the dispute shall be submitted to the courts of competent jurisdiction in Prachuap Khiri Khan Province, Thailand.
13. General Provisions
These Terms & Conditions constitute the entire agreement between you and Sala Drift regarding the use of our website and services. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right or provision does not constitute a waiver of that right. We may assign our rights and obligations under these terms without your consent. 14. Changes to These Terms
We may revise these Terms & Conditions from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms. For material changes, we will make reasonable efforts to notify active program participants directly.
